1. Acceptance of Terms

By accessing and using Ready4Comp ("the Service", "Platform", or "Application"), operated by Niche Industries, LLC ("Company", "we", "us", or "our"), you accept and agree to be bound by these Terms and Conditions ("Terms"), our Privacy Policy, and all applicable laws and regulations. If you do not agree to these Terms and Conditions in their entirety, you must immediately cease using the Service.

These Terms constitute a legally binding agreement between you (the "User", "you", or "your") and Niche Industries, LLC. By creating an account, accessing any content, or using any functionality of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Description of Service

Ready4Comp is a comprehensive competition schedule management platform designed for cheerleading, dance, and other competitive events. The Service provides users with tools to:

• View, organize, and manage competition schedules through web-based and mobile interfaces
• Parse and display PDF schedule documents from various competition providers including Cheersport, CDE (Cheer Dance Excellence), and other formats
• Filter and personalize schedule views by team, program, division, or day
• Store user preferences and schedule data locally for offline access and performance optimization
• Access real-time schedule updates and notifications (when implemented)
• Share schedule information with team members, coaches, and parents
• Export schedules in various formats (PDF, calendar integration, etc.) for personal use
• Utilize advanced features such as team tracking, performance time reminders, venue information, and competition analytics

We continuously develop and enhance the Service. Features may be added, modified, or removed at our discretion. Some features may require user registration, subscription fees, or may be offered as premium services in the future.

3. User Registration and Accounts

3.1 Account Creation

While certain features of the Service may be available without registration, creating an account provides access to additional functionality, personalization options, and enhanced features. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your password and account credentials
• Accept responsibility for all activities that occur under your account

• Coach accounts with team management capabilities
• Organization/Gym accounts for program administrators
• Competition Director accounts for event management
• Premium/Subscription accounts with enhanced features

Each account type may have different features, limitations, and pricing structures as described in our service tiers.

4. User Responsibilities and Conduct

4.1 Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Violate any applicable local, state, national, or international law or regulation
• Infringe upon or violate intellectual property rights or any other rights of Niche Industries, LLC or third parties
• Upload, transmit, or distribute any viruses, malware, or malicious code that may harm the Service or other users
• Attempt to gain unauthorized access to any portion of the Service, other users' accounts, or any systems or networks connected to the Service
• Use any automated means (bots, scrapers, crawlers) to access the Service without express written permission
• Interfere with, disrupt, or create an undue burden on the Service or connected networks
• Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity
• Collect or harvest any personally identifiable information from other users without their explicit consent
• Use the Service for any commercial purpose without prior authorization
• Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without express written permission
• Post, transmit, or share content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Engage in any conduct that restricts or inhibits any other user's use or enjoyment of the Service

4.2 Content Standards

Any content you upload, post, or share through the Service (including but not limited to comments, reviews, team information, photos, videos, or competition results) must comply with the following standards:

• Content must be accurate to the best of your knowledge
• Content must not contain false, misleading, or deceptive information
• Content must not violate any third-party rights, including copyrights and trademarks
• Content must not contain personal information of minors without parental consent
• Content must be appropriate for a general audience

4.3 Account Security

You are solely responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Ensuring your account information remains current and accurate
• Notifying us immediately of any suspected unauthorized use or security breach

5. Intellectual Property Rights

5.1 Service Content

All content, features, functionality, design elements, software, source code, algorithms, databases, and materials available through the Service, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, page layouts, underlying code, and software, are the exclusive property of Niche Industries, LLC and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

"Ready4Comp", the Ready4Comp logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Niche Industries, LLC or its affiliates. You must not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans mentioned in the Service are the trademarks of their respective owners.

5.3 Limited License

Subject to your compliance with these Terms, Niche Industries, LLC grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your personal, non-commercial use. This license does not include any right to:

• Modify or create derivative works based on the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Remove any copyright, trademark, or other proprietary notices
• Use the Service for any commercial purpose or benefit
• Download or copy account information for the benefit of another entity

5.4 User Content

By posting, uploading, or submitting any content to the Service, you grant Niche Industries, LLC a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in connection with operating and providing the Service. You represent and warrant that you own or have the necessary rights to grant this license.

6. Schedule Data and Accuracy

6.1 Data Sources

Competition schedule data provided through the Service is sourced from publicly available information, third-party competition providers, event management systems, user submissions, and automated parsing of official competition documents (PDFs, websites, etc.). We aggregate data from multiple sources to provide comprehensive schedule information.

6.2 No Guarantee of Accuracy

While we strive for accuracy and timeliness, Niche Industries, LLC does NOT guarantee the completeness, accuracy, reliability, or timeliness of any schedule information, competition data, venue information, or other content provided through the Service. Schedule information is subject to change without notice, and we are not responsible for:

• Errors or omissions in schedule data
• Changes made by competition directors or event organizers
• Last-minute schedule modifications or cancellations
• Delays in updating schedule information
• Technical issues preventing data synchronization
• Discrepancies between our Service and official competition schedules

6.3 User Verification

Users MUST verify all schedule information, performance times, venue locations, and other critical competition details with official competition sources, event organizers, team coaches, or program directors. The Service should be used as a convenience tool, not as the sole source of competition information.

6.4 User-Generated Content

Users may contribute schedule information, updates, corrections, or other data. We do not verify user-submitted content and are not responsible for its accuracy. User-generated content represents the views and information provided by individual users and not Niche Industries, LLC.

7. Payments and Subscriptions

7.1 Subscription Services

We may offer premium features, subscription tiers, or paid services. When you purchase a subscription or premium feature, you agree to pay the fees specified at the time of purchase. Subscription plans may include:

• Monthly or annual subscription options
• Team or organization subscriptions
• Competition director or event management subscriptions
• Premium features such as advanced analytics, unlimited team tracking, priority support
• Ad-free experience

7.2 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel prior to the renewal date. You authorize us to charge your payment method for recurring subscription fees. Subscription fees are non-refundable except as required by law.

7.3 Price Changes

We reserve the right to modify subscription prices at any time. Price changes will be communicated to you in advance and will apply to subsequent billing periods. Your continued use of the Service after a price change constitutes acceptance of the new pricing.

10. Disclaimers and Limitations of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, QUIET ENJOYMENT, OR ACCURACY OF DATA.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NICHE INDUSTRIES, LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Missed performances or competition opportunities
• Any other damages arising out of or relating to your use or inability to use the Service

10.4 Maximum Liability

IN ANY CASE, OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

10.5 Essential Basis

You acknowledge that these limitations of liability are an essential basis of the bargain between you and Niche Industries, LLC, and that we would not provide the Service without these limitations.

11. Indemnification

You agree to indemnify, defend, and hold harmless Niche Industries, LLC, its officers, directors, employees, agents, affiliates, licensors, and service providers from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

12. Termination and Suspension

12.1 Termination by You

12.3 Effect of Termination

13. Dispute Resolution

Before initiating any formal dispute resolution, you agree to contact us to attempt to resolve the dispute informally. We will attempt to resolve disputes in good faith.

13.2 Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service that cannot be resolved informally shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in a location mutually agreed upon or as determined by the arbitrator.

13.3 Class Action Waiver

You agree that any arbitration or legal proceeding shall be conducted on an individual basis and not as a class action, consolidated action, or representative action. You waive your right to participate in a class action lawsuit or class-wide arbitration.

We shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, network infrastructure failures, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
